These COMPUTERS AND MORE General Terms and Conditions of Use (“the Terms”) apply to you and govern your use of COMPUTERS AND MORE website and repair services provided (“the Site”).
Please read carefully the Terms before proceeding.
COMPUTERS AND MORE controls and operates the Site from its offices within the Turks and Caicos Islands.
All claims relating to the Site, including the use of the Site, the materials contained and repair services provided herein are governed by the laws of the Turks and Caicos Islands.
If you do not agree, please do not use the Site. If you choose to access the Site from another location, you do so on your own initiative and you shall be responsible for compliance with applicable local laws.
“We” or “Us” refers to COMPUTERS AND MORE, a company registered under the laws of the Turks and Caicos
Islands having our registered office at 267 Lower Bight Road, Providenciales, Turks and Caicos.
“Our” shall have the same meaning.
“You” refers to the person, company and or group accessing or using the Site and or using the repair services provided.
“Your” shall have the same meaning.
You may not transfer or assign any obligations or responsibilities arising from the Terms to third parties in any way
whatsoever, and may not make any third party a partner to responsibilities written in the Terms nor in any related
legal proceedings for to any reason whatsoever.
SITE DESCRIPTION
● COMPUTERS AND MORE is a website designed to provide computer and other technical repair services available upon request through the use of our “ticket portal” system.
● To access the services provided by the Site, you must have internet access.
● You accept that the contents of the Site are limited to the Turks and Caicos Islands. Please note that content available in your current location may become unavailable to you if you travel to another location where our content is restricted.
● COMPUTERS AND MORE reserves the right to modify, suspend, remove or disable access to the Site and any content or other materials that are offered on the Site at any time, without notice. Consequently, the Site shall not be responsible to you or any third party for any modification, suspension, removal or discontinuance of the Site.
YOUR USE OF THE SITE
● You shall be solely responsible for all associated fees and costs incurred by you in connection with or arising from your use of the Site.
● You may not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content there on, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any content, or to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. COMPUTERS AND MORE reserves the right to bar any such activity.
● You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any COMPUTERS AND MORE server, or to any of the services offered on or through the Site, by hacking, password "mining" or any other illegitimate means.
● You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of COMPUTERS AND MORE, including any COMPUTERS AND MORE account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site.
● You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site’s systems or networks, or any systems or networks connected to the Site.
● You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site.
● You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to COMPUTERS AND MORE on or through the Site or any service offered on or through the Site. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.
● You may not use the Site or any content for any purpose that is unlawful or prohibited by the Terms, or to solicit the performance of any illegal activity or other activity which infringes the rights of the Site or others.
● Your privacy and personal information are important to us. Any personal information that you provide to us will not be published but will be stored in the COMPUTERS AND MORE database for our reference. Such information may be shared by COMPUTERS AND MORE with third party service providers in the event of possible outsourcing and or any other services deemed necessary. One or more of these service providers may have limited access to your personal information given to COMPUTERS AND MORE where we deem that it is reasonably necessary to deliver the service(s).
WAIVER OF COMPENSATION
● You agree to fully indemnify us and our affiliates, directors, shareholders, employees, licensors, contract staff, partners, agents and/or customers that display their marks in conjunction with us, in respect of any damage or loss suffered by you, including legal costs and attorney’s fees, which arise from your misconduct or any violation of the Terms on your part.
● You agree to refrain from taking any action or issuing any claim against us and our affiliates, directors, shareholders, employees, or agents with respect to our use of the Site or any action undertaken by us in which we have removed any information or content, or taken any other action during the investigation of a suspected violation.
WARRANTY AND LIMITATION OF LIABILITY
● The Site is provided “as is” and without warranty or condition. We do not guarantee, represent or warrant that your access to the Site will be uninterrupted, error-free or operable at all times or accessible during any down time caused by (a) outages to any public internet backbones, networks or servers; (b) any failures of your equipment, systems or local access services; (c) previously scheduled maintenance; or (d) events beyond our control including but not limited to strikes, riots, insurrection, fires, floods, explosions, war, governmental action, labour conditions, earthquakes, natural disasters, or interruptions in Internet services to an area where our or your servers are located.
● In no event shall we, our affiliates, directors, shareholders, employees, licensors, contract staff, partners, officers or agents be liable for any damages whatsoever, including, but not limited to any incidental, consequential, special, exemplary or other damages directly or indirectly arising from (a) the use of or unavailability of the Site; (b) any action taken in reliance on, or response to, any content published on the Site; (c) any claim attributable to errors, omissions or any inaccuracy in the Site’s content; or (d) any other matter in connection with the Site, however caused, even if we have been advised of the possibility of such damages.

MODIFICATION OF TERMS
● We reserve the right to make changes to the Terms from time to time. Our updated Terms will be displayed on the Site and by continuing to access or use the Site following the changes, you agree to be bound by any changes made by us. Please check frequently to see if we have updated them.
● We reserve the right to change our rates for provision of the service(s), and when doing so we shall provide you with reasonable notice, at least 7 days prior to such change, on the Site or through such communication as we consider appropriate. If any of the changes made are deemed unacceptable to you, you may stop using the Site immediately.
DISPUTE RESOLUTION AND OTHER TERMS
● Our failure to enforce any right or provision of the Terms will not be considered a waiver of those rights. If any provision of the Terms is held to be invalid or unenforceable by a court, the remaining provisions of the Terms will remain in full force and effect.
● Any dispute or claim relating to or in connection with the execution or enforcement of the Terms or use of the Site, including without limitation, any dispute regarding the validity, interpretation, enforceability or breach of which, will be exclusively and finally resolved by the courts of the Turks and Caicos Islands.
